Judge Rules on Alex Murdaugh Retrial, Venue Move and DNA Testing Set

Judge Debra McCaslin presided over a crucial preliminary hearing in Lexington County, South Carolina, ruling on venue changes, independent DNA testing, and the admissibility of past testimony for Alex Murdaugh's upcoming April 2027 retrial. The session also featured dramatic clashes between defense attorneys and prosecutors over unverified criminal links.

The first major pretrial hearing for Alex Murdaugh's April 2027 retrial took place in Lexington County, South Carolina, with Judge Debra McCaslin addressing critical defense and prosecution motions. McCaslin officially ordered the retrial moved out of Colleton County and the entire fourteenth judicial circuit, citing a recent circuit court decision in a related civil case.

During the proceedings, the defense scored a notable victory when McCaslin authorized independent laboratory testing for unknown male DNA discovered under the fingernails of victim Maggie Murdaugh. However, she also ruled that Murdaugh's testimony from his initial trial remains admissible, subject to specific evidentiary limitations.

"We were lied to—the grand jury was lied to by SLED," said defense attorney Dick Harpootlian during a heated exchange regarding disputed evidence and investigative integrity.

Tensions escalated when the defense referenced a rumored connection to an April 2026 murder in Allendale, catching lead prosecutor Creighton Waters off guard. Law enforcement later stated that ballistic analysis showed no connection between the cartridge cases from the two separate incidents.

Judge McCaslin set the next status conference for November 13, 2026, where additional motions regarding original indictment dismissals and blood spatter evidence will be evaluated.
