The legal complaint targets Homeland Security Secretary Markwayne Mullin and acting ICE head David Venturella for allowing agents to monitor voting locations in direct violation of federal laws.

The lawsuit highlights specific aggressive actions taken by federal personnel earlier this year, including an incident in May where armed agents swarmed a San Antonio, Texas, polling site parking lot to detain a person. In a separate June incident in Syracuse, New York, immigration agents entered an active polling facility to interrogate a volunteer over social media posts.

'ICE isn't there to patrol the polling places,' defended Homeland Security Secretary Markwayne Mullin during a press briefing last week, stating that agents only respond to specific security threats or serve active warrants.

Legal analysts note that the presence of federal immigration enforcement near ballot boxes creates an intimidating environment that suppresses voter turnout, particularly within immigrant communities.

The federal court in Denver is scheduled to review the emergency injunction request next week to determine whether immigration enforcement operations must maintain a mandatory distance from all active polling stations.
