Trump Administration Asks Supreme Court to Enforce Mail Ballot Rules, Midterms Loom
The Justice Department urged the Supreme Court on Sunday to temporarily allow the U.S. Postal Service to exercise control over mail-in voting for the upcoming midterms. This legal action came only two days after U.S. District Judge Indira Talwani issued a preliminary injunction blocking the administration's USPS regulation.
The contested rule stems from a March executive order signed by President Donald Trump, permitting the postal service to track mail-in ballots and reject mail not listed in a federal database. Judge Talwani blocked the policy, writing that its rushed implementation close to the November election threatens millions of citizens with disenfranchisement.
In Sunday's filing, government lawyers defended the measure against accusations of federal overreach. "The Postal Service’s final rule imposes only modest envelope-design and addressee-information requirements for federal-election ballots," the filing stated.
Legal analysts note that this marks the third time the administration has escalated the ballot dispute to the nation's highest court. The Justice Department withdrew previous pending requests after submitting its latest application responding directly to Judge Talwani's order.
North Carolina became the first state to initiate mail-in voting for registered voters less than sixty days before the midterm polls open. Meanwhile, state election officials and lower courts continue to process ongoing legal challenges regarding federal oversight of state-run elections.
